Processing of personal data in qualifications assessment and recognition cases

The Danish Agency for Higher Education and Science processes personal data when it receives applications for assessment of foreign qualifications and applications for recognition of foreign teaching qualifications

The Agency processes personal data in order to be able to process applications for assessment of foreign qualifications and applications for recognition of foreign teaching qualifications.

Legal basis

The processing of your personal data is based on the EU data protection regulation (GDPR), article 6, paragraph 1, letter e.

In cases concerning teaching qualifications, personal data are also processed on the basis of the Act on the recognition of certain educational and professional qualifications (anerkendelsesloven) as well as the legislation for the individual profession:

Processing of information about criminal offences is based on the Danish Data Protection Act (databeskyttelsesloven), section 8, subsection (1), and subsection (2), paragraph (3).

Your Danish civil registry is processed for the purpose of unique identification, cf. section 11, subsection (1) of the Data Protection Act.

Categories of registered individuals

The Agency processes personal data of the holder of foreign qualifications and, in some cases, of another person who has submitted the application.

Categories of personal data

The Agency processes information about:

  • CPR number or date of birth
  • Name
  • Address and other contact information
  • Nationality
  • Gender
  • Educational background
  • Work experience.

Information on criminal matters is processed if the agency detects the use of falsified diplomas or the like.

Source of personal data

The personal data normally originate from the person who has submitted the application.

Transfers of personal data

The Agency may contact the educational institution or the relevant authority in the country of education to obtain confirmation that the person has completed the qualification(s) in question if the person has consented to this. The country of education does not necessarily have data security rules preventing information from reaching unauthorised persons, unless it is an EU/EEA country, Andorra, Argentina, the Faroe Islands, Guernsey, Isle of Man, Israel, Jersey, New Zealand, Switzerland, South Korea, the United Kingdom or Uruguay.

The qualification holder has the right to withdraw the consent, in which case the Agency may be unable to proceed with the assessment.

In some cases, the Agency asks an educational institution for an expert opinion. In that case, the Agency may disclose information about the person's educational background so that the educational institution can assess the qualifications.

If an assessment or decision on teacher recognition is issued, the Agency passes information about the identity of the qualification holder and about the assessment on to Statistics Denmark, which uses the information for statistical purposes only.

Submission of fraudulent documentation will be reported to the police.

Storage of personal data

Documents with personal data are filed in accordance with the rules set forth in the Access to Public Administration Files Act and are handed to the Danish National Archives in accordance with the Archives Act (approximately every 5 years). After handing the data to the Danish National Archives, the Agency keeps a copy of the personal data for approximately 5 years depending on the required period for filing. Hereafter, the personal data are deleted by the Agency.

An electronic register with information on cases, qualification holders and assessments is handed over to the Danish National Archives in accordance with the rules on electronic registers (approximately every 5 years). Personally identifiable information is kept in the register after the case is completed in order to answer inquiries about the authenticity of assessments and decisions, issue duplicates of or reissue lost assessments and decisions, reject repeated applications where the applicant has previously received an assessment, decision or refusal concerning the same qualification. The information is anonymised after 30 years. Information about nationality, gender, postal code and email address is deleted after 10 years.
